1. Introduction

Mochimota ("the Service") is operated by Hoshiko Tech Ltd. These Terms of Service govern your use of our platform. By accessing or using the Service, you agree to be bound by these Terms.

2. Account Security & "Magic Links"

Responsibility for Access:

The Service uses email-based "Magic Links" for listing management (editing and deletion). We do not use passwords.

You are solely responsible for the security of your email account.
Any action taken via a Magic Link sent to your email address is deemed to be taken by you.
Hoshiko Tech Ltd shall not be liable for any unauthorized access, modification, or deletion of listings resulting from a compromise of your email account or your sharing of a Magic Link.

3. Nature of the Service

Mochimota acts strictly as a "passive venue" for users to list items.

We are not an auctioneer, an intermediary, or a party to any transaction.
The contract of sale is solely between the Buyer and the Seller.
We do not handle payments, shipping, or dispute resolution between users.

4. Eligibility

You must be at least 18 years old to use this Service.

By creating a listing, contacting a seller, or otherwise using the Service, you confirm that you are 18 years of age or older. We do not knowingly allow use of the Service by anyone under the age of 18.

5. Prohibited Items and Content

You may not list or post content that is:

Illegal under the laws of England and Wales.
Counterfeit, stolen, or infringing on intellectual property.
Offensive, discriminatory, or harmful to minors.
Business advertisements or mass-postings (this platform is for private individuals only).

In particular, the following content is strictly prohibited and may be reported to law enforcement:

Child sexual exploitation and abuse (CSEA) material.
Terrorism content or content that encourages or glorifies terrorism.
Content inciting violence or hatred against any person or group.
Content facilitating fraud, financial crime, or the sale of illegal goods.

6. Content Moderation and Reporting

We use automated content moderation systems to detect and remove illegal and harmful content. Content identified as child sexual exploitation material is immediately deleted and reported to the National Crime Agency (NCA).

We may remove any content that violates these Terms without prior notice.

Users can report illegal or harmful content using the reporting feature on any listing. We aim to review reports promptly.

If you wish to appeal a moderation decision, please see our complaints and appeals procedure. This Service is operated in compliance with the UK Online Safety Act 2023.

7. Suspension and Termination

We reserve the right to suspend or terminate your access to the Service, including removing any listing or content you have posted, at any time and without prior notice, if we reasonably believe that:

You have breached these Terms of Service.
Your content violates applicable law or the rights of others.
Your use of the Service poses a risk to other users, third parties, or our operations.
We are required to do so by law, regulation, or a court or regulatory order.

Where practicable, we will notify you of the reason for suspension or removal. You may appeal any moderation or removal decision through our complaints and appeals procedure.

Suspension or termination does not affect any rights or obligations that have already accrued, including our right to retain data required by law (see our Privacy Policy).

8. Limitation of Liability

Legal Limit of Our Responsibility:

To the maximum extent permitted by law, Hoshiko Tech Ltd provides the Service "as is" and excludes all liability for:

Loss of profit, loss of opportunity, or any indirect or consequential loss.
The quality, safety, or legality of items listed.
Any disputes or fraudulent activity between users.
The accuracy of content generated by users.

Note: Nothing in these Terms excludes our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

9. Indemnity

You agree to indemnify Hoshiko Tech Ltd against any claims, losses, or legal fees arising from your breach of these Terms, your violation of any law, or your infringement of any third-party rights.

10. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
